Prospekt is operated by Prospekt, based in Ontario, Canada. These Terms of Service and Privacy Policy govern your use of Prospekt's lead research and lead generation services. By subscribing to any Prospekt plan, completing an intake form, or making a payment, you agree to be bound by these terms in full.
Part 1 — Terms of Service
1. Service Description
Prospekt ("we", "us", "our") is a B2B lead research and lead generation service. We source, verify, and deliver curated lists of professional business contacts to clients ("you", "your") based on criteria provided during intake.
Contact information is sourced from professional business databases and publicly available professional sources.
Our service delivers verified business contact data and informational qualification summaries. We make no representation or guarantee regarding:
- Sales outcomes
- Response rates
- Meetings booked
- Revenue generated from delivered leads
AI-generated qualification summaries are provided for informational purposes only and may contain inaccuracies or incomplete inferences based on available data.
2. Subscription & Payment
All plans are billed monthly through Stripe on a recurring basis. Your subscription renews automatically on the same calendar date each month unless cancelled.
Current Plans
Starter — $250 CAD/month (50 leads, 1 target industry, 5 business day delivery)
Growth — $500 CAD/month (100 leads, 2 target industries, verified email + phone, priority delivery)
Scale — $1,000 CAD/month (250 leads, unlimited industries, email + phone + LinkedIn, priority delivery)
If payment fails, Stripe may retry the charge. If payment is not successfully collected within 7 days, your account may be paused until payment is resolved.
Price Changes
Prospekt may update subscription pricing with 30 days written notice sent to the client's registered email address. Continued use of the service after the effective date constitutes acceptance of the updated pricing.
3. Cancellation & Refunds
Subscriptions may be cancelled at any time through the Stripe customer portal or by emailing hello@getprospekt.ca. Cancellation takes effect at the end of the current billing cycle.
We do not issue partial refunds for unused time within a billing period.
Lead lists delivered by Prospekt are considered digital goods. Once a lead list has been delivered, the service is considered fulfilled.
Clients agree not to initiate payment disputes or chargebacks after delivery. If a client believes a delivery issue has occurred, they must contact Prospekt first to allow a reasonable opportunity to resolve the issue.
Nothing in this section limits any non-waivable rights under applicable law.
4. Lead Delivery
Lead generation begins after submission of the intake form specifying criteria such as industry, geography, company size, and decision-maker title.
Starter plans are delivered within 5 business days. Growth and Scale plans receive priority delivery.
Leads are delivered digitally via spreadsheet attachment, shared sheet, or secure file link. Delivered lead data may include:
- Company name and website
- Business address
- Contact name and title
- Verified email address
- Verified business phone number
- LinkedIn URL
Phone numbers may be a company main line where a direct contact number is unavailable.
Changes to targeting criteria apply only to future lead batches and do not affect batches already delivered or in progress.
If insufficient qualifying leads exist for the requested niche or geography, Prospekt may propose revised criteria, reduced volume, delayed delivery, or a prorated adjustment.
5. Lead Quality & Replacement
Verification includes email validation, phone verification, role confirmation, and company website verification.
Verification reflects the status of the data at the time it was validated and cannot guarantee future accuracy due to changes in employment, company status, or contact information.
Eligible Replacement Conditions
A lead may qualify for replacement if:
- Email returns a hard bounce
- Phone number is disconnected
- Company permanently closed
- Contact never existed at the company
- Company located outside requested geography
Not Eligible for Replacement
Leads are not eligible for replacement due to:
- Lack of response to outreach
- Contact not interested in the offer
- Job changes after delivery
- Company not currently buying
- Criteria changes after delivery
- Replacement requests submitted more than 30 days after delivery
Replacement Requests
Replacement requests must be submitted to hello@getprospekt.ca within 30 days of delivery and must include the lead name, company, and reason for the request. Approved replacements will typically be delivered within 24–48 hours.
6. Acceptable Use
Clients may use delivered lead lists only for internal business prospecting purposes. Clients may not:
- Resell or redistribute lead lists
- Publish lead lists publicly
- Upload lists to public marketplaces
- Sublicense lead data to third parties
- Use leads for unlawful messaging or harassment
- Violate CASL or other applicable laws
Prospekt may suspend or terminate service if lead data is used unlawfully or in violation of these Terms.
7. CASL Compliance
Prospekt provides professional business contact data but does not send outreach messages on behalf of clients.
Prospekt does not determine whether express or implied consent exists between the client and any contact included in a delivered lead list.
Clients are solely responsible for ensuring their outreach complies with Canada's Anti-Spam Legislation (CASL), PIPEDA, the Competition Act, and any other applicable communications laws.
8. Client Indemnification
Clients agree to indemnify, defend, and hold harmless Prospekt, its owners, employees, contractors, and affiliates from any claims, investigations, penalties, damages, or legal costs arising from misuse of delivered lead data, unlawful outreach campaigns, or violations of CASL or other communications laws.
9. Intellectual Property
All methodologies, workflows, automation systems, verification processes, and internal operating procedures used by Prospekt remain the intellectual property of Prospekt.
Clients receive a non-exclusive, non-transferable license to use delivered lead lists solely for internal business prospecting.
10. Third-Party Services
Prospekt relies on third-party providers including Apollo.io, NeverBounce, NumVerify, Zapier, and Anthropic Claude API. Prospekt is not responsible for delays, interruptions, or inaccuracies caused by outages or failures of third-party services.
11. Limitation of Liability
Prospekt's total liability for any claim related to the service shall not exceed the subscription fees paid in the calendar month in which the claim arose.
The service is provided on an "as-is" and "as-available" basis. Prospekt shall not be liable for lost profits, lost opportunities, business interruption, or indirect or consequential damages.
12. Service Suspension or Termination
Prospekt may suspend or terminate a client's access to the service if payment obligations are not met, delivered lead data is misused, the client violates these Terms, unlawful activity is suspected, or continued service presents legal or reputational risk.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Disputes will first be addressed through good-faith mediation before either party may commence litigation.
14. Changes to These Terms
Prospekt may update these Terms from time to time. Material changes will be communicated by email or posted on the website. Continued use of the service after such changes take effect constitutes acceptance of the updated Terms.
Part 2 — Privacy Policy
Prospekt collects limited information necessary to provide its services in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). Our services are intended for business clients only and are not directed toward individuals under the age of 18.
1. Information We Collect
Information collected from clients may include name, business email, phone number, company name, and lead criteria preferences.
Lead research may involve collecting professional business contact information including name, business email, job title, company name, company phone number, and business address. This information relates to individuals in their professional capacity only.
2. How We Use Information
We use client information to deliver our services, process billing, communicate regarding the account, respond to support requests, and enforce our Terms of Service.
Lead-related information is used to research, verify, curate, and deliver lead datasets to clients.
3. Data Processing & Storage
Data may be processed by third-party providers including Google Workspace, Stripe, Zapier, Apollo.io, NeverBounce, NumVerify, and Anthropic Claude API. Some providers may process data on servers located outside Canada, including in the United States.
4. Data Retention
Lead data is retained for 30 days after delivery to support replacement requests. Client account data may be retained for up to 90 days following cancellation.
5. Data Security
Prospekt implements reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, or disclosure.
If a security incident creates a real risk of significant harm, Prospekt will notify affected individuals and the Office of the Privacy Commissioner of Canada as required by PIPEDA.
6. Your Rights
You may request access, correction, or deletion of personal information by contacting hello@getprospekt.ca. Requests are subject to applicable legal, contractual, and operational retention requirements.

By subscribing to the service, completing an intake form, or making a payment, you acknowledge that you have read and agree to these Terms of Service and Privacy Policy.
